These Terms and Conditions govern the relationship between Elevate Imaging (“the Provider”) and the Client (“the Client”) for the provision of Unmanned Aircraft System (UAS) services.
1. Professional Disclaimer
Elevate Imaging provides high-resolution aerial imagery, video, and data (including photogrammetry and thermal data).
- Non-Surveyor Status: We are professional Remote Pilots, not Qualified Chartered Surveyors or Structural Engineers.
- Data Interpretation: All data, imagery, and maps provided are for the Client’s own use and interpretation. We do not provide professional certifications, structural sign-offs, or legal land boundary determinations.
- Independent Review: The Client is responsible for having the data reviewed by a suitably qualified professional (e.g., RICS Surveyor or Structural Engineer) before making any safety-critical or financial decisions.
2. Flight Operations & Safety
- CAA Compliance: All flights are conducted in accordance with Civil Aviation Authority (CAA) regulations and our own Operational Authorisation (OA).
- Pilot Authority: The Remote Pilot in Command (RPIC) has the final authority on whether a flight is safe to proceed. This includes, but is not limited to, weather conditions, airspace restrictions, and site-specific risks.
- Cancellations: If a flight is cancelled due to weather or safety concerns, Elevate Imaging will reschedule at no additional cost. If the Client cancels within 48 hours of the flight, a 25% fee may apply.
3. Permissions & Site Access
- Access: The Client is responsible for securing all necessary permissions from landowners to take off and land on private property.
- Notifications: Elevate Imaging will handle NATS/ATC notifications and flight plan filings where required.
4. Intellectual Property & Usage
- Licensing: Upon full payment, the Client is granted a non-exclusive, perpetual licence to use the data/imagery for the intended purpose.
- Copyright: Elevate Imaging retains the copyright to all raw footage and data unless a full copyright transfer is agreed upon in writing.
- Portfolio Use: We reserve the right to use snippets of captured footage for our own promotional purposes (website/social media) unless a Non-Disclosure Agreement (NDA) is requested by the Client in advance.
5. Payment Terms
- Quotations: Quotes are valid for 30 days.
- Deposits: A deposit of 25% may be required to secure a booking date.
- Final Delivery: Final high-resolution data will be released upon receipt of the full remaining balance.
6. Limitation of Liability
- Direct Loss: Our liability for any claim shall be limited to the total fees paid by the Client for the specific project.
- Indirect Loss: Elevate Imaging is not liable for any indirect, consequential, or economic loss, including loss of profits or delays in construction schedules, arising from the data provided.
7. Insurance
Elevate Imaging maintains valid Public Liability Insurance up to £5,000,000 specifically for commercial drone operations, compliant with EC 785/2004.
8. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
